Do I need a party wall agreement for a loft conversion? The short answer
Yes, in almost all cases. If your loft conversion involves cutting into the shared wall (the party wall) to insert steel beams (RSJs), raising the party wall, or altering the roof structure that adjoins your neighbour, you must serve a Party Wall Notice and obtain a Party Wall Agreement.
What is the Party Wall etc. Act 1996?
The Party Wall Act is a legal framework designed to prevent and resolve disputes between neighbours related to party walls, boundary walls, and excavations near neighbouring buildings.
It requires the building owner (you) to notify the adjoining owner (your neighbour) of the proposed works. It is a legal requirement, not a courtesy.
When Does the Act Apply to Loft Conversions?
If you live in a terraced or semi-detached property in Hampshire or Surrey, you share at least one wall with a neighbour. The Act applies if your loft conversion involves:
- Cutting into the party wall to insert bearing plates or steel beams.
- Raising the height of the party wall (e.g., for a dormer extension).
- Removing a chimney breast from the party wall.
- Demolishing and rebuilding the party wall.
The Party Wall Process
You must serve a formal Party Wall Notice to your neighbour at least two months before the work begins. Your neighbour then has 14 days to respond. They can either:
- Consent: The work can go ahead (though we still recommend a Schedule of Condition).
- Dissent: A dispute is officially recognized, and you must appoint a Party Wall Surveyor to draft a Party Wall Award.
What is a Party Wall Award?
A Party Wall Award is a legally binding document drafted by the surveyors. It details exactly what work will be done, how and when it will be carried out, and includes a Schedule of Condition (a photographic record of the neighbour's property before work starts) to protect both parties against false damage claims.
